Maryland law distinguishes between driving under the influence (DUI) and driving while impaired (DWI) based on person's blood alcohol content (BAC). DUI is the more serious of the two charges. Any reading above a .06 will lead to an alcohol related charge. Charges may also be initiated if the police feel that a person is under the influence of prescription medication or a controlled dangerous substance, or some combination thereof. The potential penalties of even a first DUI or DWI-related conviction include:

  • DUI - up to one year in jail and $1,000 in fines, 12 points on your driver's license, and a six months minimum license suspension
  • DWI - up to two months in jail and $500 in fines, eight points on your driver's license, and a six months license suspension
  • Underage DUI - Maryland has a zero tolerance law for minors found driving under the influence, which means a BAC of only .02 percent is enough to be charged with DUI and could result in a $500 fine and a 45 day driver's license suspension
  • DUI or DWI with a minor in the vehicle - If transporting a minor at the time of arrest, a person may be sentenced to two years in jail for DUI and up to six months in jail for DWI, and fines may be doubled.
